No, that's not true. You can play games LIVE on a flashed Xbox. The question is, is the game "backup" or an original? If its "backup" and It's not released yet, then yes, you will get banned. So Don't play unreleased games! Wait until they're released. And alway check ABGX servers to see if the game has been OK'd by them.
